Every access to our website and every retrieval of a file stored on the website is logged. The data is stored for internal system-related purposes.

The following information is recorded:

  • Date and time of access
  • Requested URL

§ 4 Cookies

(1) This website uses so-called cookies in several places. A cookie is a small data file that a website sends to your browser and stores on your device as an identifier to recognize your system.

Cookies are commonly used to measure website usage (such as the number of visitors and the duration of visits), evaluate the effectiveness of a website (for example, identifying topics that are of greatest interest to visitors), and simplify navigation and website functionality. In these cases, cookies are generally not linked to personal data.

However, cookies may also be used to personalize the browsing experience of returning visitors. In such cases, a connection to an individual user may be established by associating profile information or user preferences. Over time, this information provides valuable insights that help us improve the user experience of our website.

(2) Cookies are generally divided into session cookies and persistent cookies.

Session cookies enable efficient navigation through the website by recording your progress across individual pages. This prevents you from having to re-enter information that you have already provided during the same browsing session. Session cookies are stored temporarily and are automatically deleted when you close your browser.

Persistent cookies, on the other hand, store user preferences for both the current visit and future visits to the website. They remain stored on your device even after the browser has been closed. For example, we use persistent cookies to remember your preferred language and country settings.

(3) Since essential cookies (required for the basic functionality of the website) and functional cookies (used to analyze website usage and improve performance) are necessary for certain features of our website, we recommend that you do not disable cookies completely in your browser settings.

If your browser allows you to block third-party cookies (such as marketing or targeting cookies used to display advertisements and track your browsing activities), the functionality of our website will not be affected.

§ 5 Google Fonts

This website uses external fonts provided by Google Fonts, a service of Google LLC ("Google").

The integration of Google Fonts is carried out by requesting the fonts from Google servers, which are generally located in the United States. As a result, Google receives information about which pages of our website you have visited. Your browser's IP address is also transmitted to Google.

Further information can be found in Google's Privacy Policy.

§ 6 Use and Disclosure of Personal Data

(1) If you provide us with personal data, we will use it solely for the purpose of responding to your inquiries, for the technical administration of our website, and—where you have given your consent—for marketing purposes.

Your personal data will only be disclosed or otherwise transferred to third parties if:

  • this is necessary for the performance of a contract, particularly for the transmission of order and delivery data to suppliers or shipping service providers;

  • it is required for billing purposes;

  • we are legally obliged to do so; or

  • you have given your prior consent.

Personal data is not transferred to countries outside the European Union.

(2) You have the right to withdraw any consent you have given at any time with effect for the future.

(3) Stored personal data will be deleted if you withdraw your consent to its storage, if the data is no longer required for the purpose for which it was collected (i.e. once the relevant process has been completed), provided that no statutory retention obligations apply, or if storage is otherwise unlawful.

Where deletion is not possible due to statutory retention periods, the data will be blocked from further processing until those retention periods expire.

(4) In the event of a breach of contract, we may disclose your personal data to persons or organizations entrusted with the enforcement of claims and rights on behalf of Zimmer GmbH Dämpfungssysteme.

§ 7 Online Orders

(1) When placing an online order, you provide personal data that can be used to identify you, such as your first name, last name, address, telephone number and email address.

Private customers may place orders as a guest without creating a customer account or alternatively register for a password-protected customer account.

Business customers are required to create a customer account and register their company before placing an order.

The customer account provides an overview of completed orders and current order processes.

The operator accepts no liability for the misuse of passwords unless such misuse is attributable to the operator.

Where personal data (such as name, address or email address) is collected on our website, this is generally done on a voluntary basis wherever possible.

We use your personal data exclusively for the purpose of fulfilling the contract.

For the delivery of ordered goods, only the data required for shipping and order processing will be passed on to service providers (e.g. DHL).

Your personal data will be deleted as soon as it is no longer required or no longer needs to be retained by law.

(2) We only transfer personal data to third parties where this is necessary for the execution of the contract, for example to the financial institution responsible for processing payments.

(3) Your data will not be disclosed beyond this unless you have expressly consented to such disclosure.

Your personal data will never be disclosed to third parties for advertising purposes without your explicit consent.

(4) The legal basis for this processing is Article 6(1)(b) GDPR, which permits the processing of personal data for the performance of a contract or for pre-contractual measures.

§ 8 PayPal

(1) We offer payment via PayPal on our website.

The provider of this payment service is:

PayPal (Europe) S.à r.l. et Cie, S.C.A.
22–24 Boulevard Royal
L-2449 Luxembourg

(hereinafter referred to as "PayPal").

(2) If you choose to pay via PayPal, the payment information you enter will be transmitted to PayPal.

(3) Your data is transferred to PayPal on the basis of:

  • Article 6(1)(a) GDPR (your consent), and

  • Article 6(1)(b) GDPR (processing necessary for the performance of a contract).

You may withdraw your consent to data processing at any time. Such withdrawal does not affect the lawfulness of processing carried out before the withdrawal.

§ 9 Registration on this Website

(1) You may register on our website in order to use additional website functions.

The personal data entered during registration will be used solely for the purpose of providing the service or functionality for which you registered.

All mandatory information requested during registration must be provided in full. Otherwise, we may reject your registration.

(2) For important changes, such as changes to our services or technically necessary updates, we will use the email address provided during registration to inform you accordingly.

(3) The data entered during registration is processed on the basis of your consent in accordance with Article 6(1)(a) GDPR.

You may withdraw your consent at any time by sending us an informal email.

The withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

(4) The personal data collected during registration will be stored for as long as you remain registered on our website.

After your registration has ended, the data will be deleted unless statutory retention obligations require otherwise.

§ 10 Miscellaneous

(1) Automated Decision-Making

We do not use automated processing, including profiling, that results in automated decision-making concerning you.

(2) Visable Analytics and Marketing Services

Zimmer GmbH Daempfungssysteme uses products and services provided by Visable GmbH (www.visable.com) for analytics and marketing purposes.

For this purpose, data is collected, processed, and stored using tracking pixel technology to create user profiles that are at least pseudonymized and, where possible and appropriate, fully anonymized.

The data collected, which may initially include personal data, is either transmitted to Visable or collected directly by Visable and used exclusively to create the user profiles described above.

Visitors to this website are not personally identified, nor is any other personal data combined with these user profiles.

If IP addresses are considered personal data, they are deleted immediately.

You may object to this type of data processing at any time with effect for the future by using the available opt-out option ("Exclude visitor tracking"). This opt-out sets a first-party cookie to prevent future tracking.
